Hospital Choking Assault & Threats — Charges Withdrawn

R. v. X.X. – 2025 – 4941

Allegation:

X.X. was charged with assault, assault by choking, and uttering threats following an incident at the Hospital. According to police and emergency staff, X.X. had been brought in for treatment and allegedly became combative with medical personnel. It was claimed that he grabbed a nurse by the neck, attempted to choke her, and threatened to kill her while she tried to assist. Witnesses described the nurse as visibly shaken and reported red marks on her throat. Additional hospital staff and EMS personnel allegedly corroborated the incident.

Assault by choking is treated as an especially serious offence in Canadian criminal law. It involves physical contact that risks unconsciousness or death, and even first-time offenders routinely face jail if convicted. When such allegations occur in a hospital setting—and involve threats to a health care professional—the Crown often seeks a significant sentence and refuses to resolve the matter without a conviction.

Result:

Sean Fagan represented X.X. The matter proceeded through pre-trial stages and was formally scheduled for trial. On the morning the trial was set to begin, Mr. Fagan raised a highly technical legal issue related to the evidentiary framework and procedural fairness of the investigation. After highlighting the issues in the prosecutor’s case, the prosecution withdrew all charges.
