Sex Offences
“Special Considerations”
In today’s political climate, the pressure to uncritically believe the complainant is immense.
Everyone is abundantly aware (or should be aware) of the fact that “no” means “no” and that stereotypical beliefs and myths surrounding sexual activity have absolutely no place in our criminal justice system.
What happens, however, when a person claims that the “yes” they clearly communicated to you during the heat of the moment was a “no” – the morning after, a week later, or sometimes years later? What happens when consent to engage in sexual relations is non-verbal and you’ve misunderstood the signs, or a person has lied to you about his/her age? What do you do when your estranged spouse or significant other falsely accuses you of molesting your own child?
Your innocence will not spare you the risk, uncertainty and anxiety associated with criminal proceedings. Furthermore, you cannot rely on the police to conduct a thorough and impartial investigation. In today’s political climate, the pressure to uncritically believe the complainant is immense. More often than not the police will simply arrest you, charge you with a sex crime, and leave you to the courts. Meanwhile, your future hangs in the balance.
Sean Fagan understands the unique dynamics at play in these cases, and has experience in successfully defending them.
