R. v. X.X. – 2025 – 2661
Allegation:
During the Calgary Stampede, X.X. was alleged to have assaulted his spouse in a busy downtown area. According to police and multiple civilian witnesses—none of whom knew the parties—it was reported that X.X. shouted slurs at his partner and struck her repeatedly in public view. Some witnesses claimed to have seen her fall to the ground. Others described X.X. continuing to hit her in the face and head as she tried to walk away. When police arrived, they noted visible bruises and bleeding to her forehead. Based on these observations, and the consistency of witness reports, X.X. was arrested and charged with assault under section 266 of the Criminal Code. The incident took place in a highly public setting, making this a difficult case to defend. The courts would have significant concern with the location, timing, and nature of the allegations.
Result:
Sean Fagan was successful. Charges withdrawn.
