R. v. X.X. – 8751
Allegation
X.X. was charged in Saskatoon, Saskatchewan with possession of cocaine for the purpose of trafficking, contrary to section 5(2) of the Controlled Drugs and Substances Act. Police alleged that X.X. was involved in the distribution of controlled substances and connected him to a quantity of cocaine and a significant amount of Canadian and U.S. currency.
Charges of this nature are taken seriously in Saskatchewan courts, particularly when tied to cash and other indicators of drug trafficking. Convictions often result in lengthy jail sentences, even for those without prior records, and typically proceed by indictment. The case was treated as a major trafficking file and was subject to federal prosecution.
Result
Devlin Gavigan of Sean Fagan’s office acted as defence counsel. Mr. Gavigan secured a stay of proceedings before the matter advanced to trial. A stay formally brings the prosecution to a close. X.X. avoided a criminal record, avoided incarceration, and walked away from a serious trafficking prosecution.
