Dangerous Driving – Section 249 of the Criminal Code of Canada
I.L.D. was on his way to his first day on the job when he was involved in a motor vehicle accident. A multitude of civilian witnesses observed I.L.D.’s vehicle speed through a playground zone and rear end a minivan. All witnesses confirmed that I.L.D. did not even apply his brakes before he crashed into the back of the minivan. The minivan sustained significant damage, but thankfully all members of the vehicle were unharmed; however, the puppies that were located in the rear of the minivan were not so fortunate. Following the accident, I.L.D. was observed walking around the accident scene behaving in an unusual manner. The Calgary Police Service arrived, and I.L.D. was arrested and charged with the criminal offence of dangerous driving. Sean Fagan was successful at establishing that I.L.D. suffered an acute seizure in the moments preceding the accident and convinced the Crown to withdrawal the criminal charge and agreed to a plea to a traffic ticket.
