Regina v. R.S. – Jan 2019

Charge: failure to remain, hit and run.

R.S. faced a multitude of offences for his alleged driving behaviour.  It was alleged that R.S. side swiped a vehicle on Deerfoot trail, refused to stop his vehicle, and took off from the scene.  He was then alleged to have driven directly through a LRT barrier, again failing to remain at the scene of the accident.  Both the driver of the vehicle on Deerfoot, and a witness to the LRT collision immediately contacted the police.  The witness pursued R.S. to obtain a description of the vehicle and driver.  The witness noted a reckless driving pattern, and believed the driver to be impaired, or perhaps operating a stolen vehicle. 

The police caught up to R.S. a short time later and charged him with a multitude of driving related offences. R.S. was highly knowledgeable in his legal rights, and he did not prejudice his legal position by providing any incriminating statements.

R.S. was given a Court date where his appearance was required. Unfortunately, R.S. did not appear in Court for reasons out of his control, and warrants issued for his arrest. 

 R.S. retained lawyer Sean Fagan to represent him in the defence of these matters.  R.S. was successful at having the warrants against R.S. vacated, and scheduled the matter for trial.  If R.S. was convicted of any one of the offences, he was at risk of losing his license, and incurring a serious fine.  On the day of trial Sean Fagan was successful at securing the withdrawal of all charges.
