Multi-Count Domestic Violence (Assault, Weapon, Forcible Confinement) — Charges Withdrawn

R. v. X.X. – 2025 – 5051

Allegation

X.X. was charged in Calgary with multiple offences involving allegations of abuse against his children and former spouse. The charges included assault, assault with a weapon, uttering threats, and forcible confinement. The allegations were said to span several years and involved multiple children. The complaints were brought forward shortly after divorce proceedings were initiated—something that often introduces added complexity into already sensitive matters. Allegations arising in this context may be genuine, exaggerated, or entirely fabricated, but they are always treated seriously by police and prosecutors.

The Crown was unwilling to resolve the matter in any way that didn’t involve a conviction and a custodial sentence. No alternative resolution was offered, and the case was set for trial.

Result

In the weeks leading up to trial, Sean Fagan strategically advised the Crown of technical and evidentiary issues with the Crown’s case. After further engagement with the prosecution, he successfully persuaded the Crown to withdraw all charges. No plea was entered. No trial occurred. No conviction was recorded.
