Allegation
X.X. was charged in Calgary with a number of very serious firearms offences. Police alleged that he was found in illegal possession of a number of restricted firearms. Overcapacity magazines and improperly stored ammunition were also part of the investigation.
These are very serious charges. In Canada, convictions for possession of loaded or improperly stored restricted firearms often lead to mandatory jail time—even for individuals with no prior criminal record. The case attracted added attention from law enforcement due to X.X.’s status as a prior target of police surveillance and enforcement.
Result
Sean Fagan was retained early in the process and began working to resolve the matter before it advanced to trial. Ultimately, he was successful at securing the withdrawal of all criminal charges. No trial was scheduled, no plea was entered, and no conviction was recorded. The result avoided the significant costs and stress associated with trial proceedings—and eliminated the very real risk of a penitentiary sentence.
