Calgary Meth Trafficking (Vehicle) — Stay of Proceedings

R. v. X.X. – 2025 – 5561

Allegation

While patrolling near downtown Calgary, police observed a man behaving erratically outside a vehicle. The man, later identified as the accused, was seen dancing around the vehicle before climbing inside and sprawling across the driver’s seat with the door open. Officers initiated a traffic stop and noted the accused appeared impaired. When asked for documents, he provided insurance but failed to locate the registration. Officers arrested him for impaired care and control of a motor vehicle.

A search of the vehicle allegedly uncovered a substantial quantity of suspected methamphetamine, including white and tan crystal substances and multiple bags commonly used for street-level trafficking. Officers also located a portable scale, dozens of empty dime bags, and a debit card in the accused’s name inside the tote containing the drugs. X.X. was charged with possession of methamphetamine for the purpose of trafficking under section 5(2) of the Controlled Drugs and Substances Act. 

These types of charges can carry lengthy prison sentences and are often built on circumstantial evidence like proximity, packaging, and movement within the vehicle. Challenging the legality of the stop, search, and continuity of possession is central to defending trafficking allegations of this kind.
