Calgary Loaded Handgun & Proceeds (Gang Operation) — Charges Withdrawn, Cash Returned

R. v. X.X. – 2025 – 2151

Allegation:

X.X. was charged in Calgary after a high-risk operation conducted by the Organized Crime Response Unit, a specialized policing team focused on firearm, drug, and gang-related investigations. This particular case was part of a broader operation targeting individuals alleged to be involved in an Asian organized crime network suspected of trafficking drugs, firearms, and currency across Alberta.

Pursuant to multiple search warrants, police entered several residences and arrested X.X. inside a basement suite. Investigators claimed they discovered a loaded handgun with a bullet chambered, a high-end designer purse filled with bundled cash, and a safe containing nearly $200,000 in Canadian currency. Officers also seized drug-related paraphernalia, digital scales, and handwritten records—referred to as “score sheets”—that they claimed were indicative of trafficking or black-market transactions.

The Crown charged X.X. with:

  • Possession of proceeds of crime over $5,000
  • Possession of a prohibited firearm
  • Possession of a restricted firearm with ammunition
  • Possession of a firearm contrary to a prohibition order

These are among the most serious weapons and financial crime offences under the Criminal Code. In Canada, the unlawful possession of a loaded firearm—especially in the context of organized crime or under a firearms prohibition—carries a strong presumption of jail. Sentences often begin in the range of 3 to 5 years federally, and can increase dramatically when the Crown links the accused to gang activity or substantial cash proceeds.

Anyone facing firearm or proceeds of crime charges in Calgary needs a defence lawyer with experience challenging search warrants, asset seizures, and gang-related allegations. These cases are complex and require early, aggressive legal strategy—especially when police overreach or cut corners in their effort to “make a statement” in public safety operations.

Result:

Sean Fagan was retained to defend the charges. All charges withdrawn.

In addition, Mr. Fagan secured the return of the full amount of cash seized during the arrest—a rare outcome in organized crime and firearm prosecutions. In a case where the accused was facing multiple years in federal prison, the matter ended with a full withdrawal and no criminal record.
