Calgary Impaired Rollover & Fail-to-Remain — Stay of Proceedings

R. v. X.X. – 2025 – 2751

Allegation

X.X. was charged in Calgary with impaired driving, operating a vehicle with a blood alcohol concentration over the legal limit, and failing to remain at the scene of an accident. According to police, the charges stemmed from a single-vehicle rollover that occurred late at night in a residential area. It was alleged that X.X. had been driving at the time of the crash and fled the scene on foot, only to be located nearby and arrested. The Crown took the position that the breath test results and observations from officers supported all three charges.

Result

Win. Stay of proceedings. A stay is a formal decision to halt the prosecution.
