R. v. X.X. – 2025 – 3161
Allegation:
X.X. was accused of damaging property inside a secure room at a Calgary hospital after becoming agitated during a medical confinement. Hospital staff and peace officers reported that he struck the walls and equipment with a metal chair in what appeared to be an attempt to escape. Surveillance footage was said to capture the outburst, including damage to a restraint chair and other hospital property. The damage was estimated at over $1,000. Officers attended the scene, arrested X.X., and charged him with mischief. The Crown relied on CCTV, statements from hospital staff, and photographs of the damaged items as part of its case.
Result:
Sean Fagan was hired to defend the charge. After reviewing the evidence and engaging with the Crown early, he was able to convince the prosecution to withdraw the charge completely. The case ended without a conviction or plea, and X.X. avoided a criminal record and all the consequences that would have followed.
