R. v. X.X. –4161
Allegation:
X.X. was accused of stealing ammunition from a Calgary outdoor supply store. According to police and store staff, surveillance footage allegedly showed him entering the ammunition section, handling a box of rounds, and concealing the contents before walking out without paying. Staff members gave a description that police later matched to still images from the footage. Investigators claimed they identified X.X. by checking licence plate data and comparing stored images from police records. The vehicle seen in the footage was allegedly connected to X.X., who was then charged with theft under $5,000 under section 334(b) of the Criminal Code. The Crown’s case leaned heavily on video surveillance, staff accounts, and internal store documentation.
Result:
Devlin Gavigan represented X.X. and successfully negotiated a full withdrawal of the prosecution.
